Terms of Service & Sale — The Reserve Room

These Terms of Service and Sale (“Terms”) govern your use of The Reserve Room website and your purchase of products from The Reserve Room. By accessing our website, placing an order, or purchasing a product, you agree to these Terms and our other posted policies.

1. Age Requirement

You must be 21 years of age or older to purchase age-restricted products from The Reserve Room.

By placing an order for an age-restricted product, you represent that you are at least 21 years old and legally permitted to purchase and receive the product at the shipping destination provided.

We may require age or identity verification before accepting, processing, or fulfilling an order. Failure to complete required verification may result in cancellation.

2. Hemp-Derived Products

Products identified as hemp or hemp-derived are offered based upon the product information, supplier documentation, and laboratory testing applicable to those products.

Laws and regulations concerning hemp-derived cannabinoids may vary by jurisdiction and may change over time.

The availability of a product on our website does not constitute a representation or guarantee that the product may lawfully be purchased, possessed, transported, or used in every jurisdiction.

We reserve the right to restrict products or destinations and to refuse or cancel an order when we determine that fulfillment would conflict with applicable requirements or our business policies.

3. Customer Responsibility

You are responsible for determining whether you may lawfully purchase, receive, possess, and use a product at your location.

You agree to provide accurate, complete, and current information when placing an order, including your age, billing information, contact information, and shipping address.

You may not purchase products on behalf of a person who does not satisfy the applicable age requirements.

4. Product Information

We make reasonable efforts to accurately describe and represent our products.

Natural agricultural products may vary between batches in appearance, color, aroma, moisture, structure, and other characteristics. Photographs are intended to provide a reasonable representation but cannot guarantee that every unit will appear identical.

We reserve the right to correct typographical errors, inaccurate descriptions, pricing errors, inventory errors, or other mistakes appearing on the website.

5. Certificates of Analysis

When available, Certificates of Analysis (“COAs”) or other laboratory reports are provided to allow customers to review testing information associated with products or batches.

The scope of testing varies between reports. A report showing cannabinoid potency alone should not be interpreted as confirming testing for pesticides, heavy metals, microorganisms, residual solvents, or other substances unless those tests are specifically identified in the report.

Laboratory results relate to the sample tested and are subject to the information and limitations stated by the laboratory.

6. Orders and Acceptance

Submitting an order does not guarantee that the order will be accepted or fulfilled.

The Reserve Room reserves the right to refuse, hold, or cancel an order before shipment for legitimate business, verification, compliance, inventory, payment, fraud-prevention, or shipping reasons.

This may include circumstances involving unsuccessful age verification, payment authorization problems, suspected fraud, inventory shortages, incorrect pricing, incomplete shipping information, restricted destinations, or other circumstances preventing fulfillment.

If we cancel an order after collecting payment and the merchandise has not been fulfilled, the applicable amount will be refunded as appropriate.

7. Prices and Payment

Prices are displayed in U.S. dollars unless otherwise indicated.

Applicable taxes, shipping charges, and other charges will be displayed during checkout when applicable.

Payment must be successfully authorized through an available payment method before an order is fulfilled.

We reserve the right to correct genuine pricing or listing errors before fulfillment. If an error materially affects an order, we may contact you for instructions or cancel and refund the affected order.

8. Shipping

Shipping is governed by our separately posted Shipping Policy, which is incorporated into these Terms.

Processing time and carrier transit time are separate. Certain limited-release products may have extended processing periods as identified on the applicable product listing.

We reserve the right to restrict shipment to destinations where a product cannot be fulfilled under our current requirements or policies.

9. Returns and Refunds

All sales are final.

Returns, exchanges, replacements, store credits, and refunds are not provided unless expressly approved by The Reserve Room or otherwise required by applicable law.

Any exception is made at our discretion and does not modify our general final-sale policy or create an obligation to provide the same resolution in another case.

10. Responsible Use

Certain hemp-derived products may produce intoxicating or impairing effects.

Do not drive, operate machinery, or perform activities requiring unimpaired judgment or coordination after consuming an intoxicating product.

Products should be stored securely and kept away from children and animals.

Use of hemp-derived cannabinoid products may result in a positive drug test.

11. No Medical Advice

Statements and information appearing on our website are provided for general informational purposes and are not intended as medical advice.

Products and website information are not intended to diagnose, treat, cure, or prevent any disease.

Customers with medical questions or concerns should consult an appropriate healthcare professional.

12. Prohibited Use

You may not use our website or products for unlawful purposes, attempt to circumvent age or identity verification, provide false information, interfere with website security, engage in fraudulent transactions, or otherwise misuse our services.

We reserve the right to refuse service or cancel orders associated with suspected fraud, abuse, or deliberate attempts to circumvent our policies.

13. Intellectual Property

Unless otherwise indicated, The Reserve Room website content—including original branding, text, graphics, logos, photographs, and other original materials—is owned by or licensed to The Reserve Room and may not be reproduced or commercially used without authorization except as permitted by law.

14. Third-Party Services

Our store may use third-party providers for services including ecommerce hosting, payments, age verification, fraud prevention, analytics, and shipping.

Those providers may operate under their own terms and privacy practices.

The Reserve Room is powered by Shopify, which provides the ecommerce platform used to operate the store.

15. Limitation of Liability

To the fullest extent permitted by applicable law, The Reserve Room will not be liable for indirect, incidental, special, or consequential losses arising from use of the website or products.

Nothing in these Terms excludes or limits liability or consumer rights that cannot lawfully be excluded or limited.

16. Changes to These Terms

We may update these Terms periodically to reflect changes in our products, practices, services, or applicable requirements.

The current version will be posted on our website with an updated revision date. Continued use of the website after an update constitutes acceptance of the revised Terms to the extent permitted by applicable law.

17. Governing Law

These Terms are governed by the laws applicable in the State of North Carolina, without regard to conflict-of-law principles, except where applicable law requires otherwise.
